ORDER : M. Sathyanarayanan, J. By consent, all the writ petitions are taken up for final disposal. Since the issue involved and to be adjudicated in the above writ petitions is one and the same, the said writ petitions are disposed of by the following common order. 2. Mr. A.N. Thambidurai, learned Special Government Pleader accepts notice on behalf of the respondents 1 to 5 in all the writ petitions. 3. [a] WP.No.26364/2017:- The petitioner in the affidavit filed in support of this writ petition would aver among other things that she claims to be the owner of the land comprised in Survey No.78/1 situate at Sholinganallur Taluk, Vengaivasal Village, Vengaivasal Main Road, Santhosapuram, Chennai-600 073 and she would aver that she is in possession and enjoyment of the said property for more than 30 years and even prior to her, her predecessors in title have been paying property taxes and other taxes for the past 25 years and her possession had also been acknowledged by the concerned authorities by extending water supply and sewage connection, electricity supply connection etc. The petitioner has also been issued with Ration Card, Voter ID Card and Aadhar Card. The petitioner had also applied for patta in respect of the land in her possession and would claim that pattas have been issued to some of the owners in S.No.78/1. The petitioner would also aver that to her shock and surprise, she has been issued with the notice under section 6 of the Tamil Nadu Land Encroachment Act, 1905, alleging that she has encroached upon the land classified as Meikkal Poramboke in S.No.78/1 admeasuring to an extent of 00298 sq.m. and put up a superstructure and challenging the legality of the same, she filed an appeal under section 10 of the Tamil Nadu Land Encroachment Act, 1905, to the 1st respondent along with the petition for stay and in spite of pendancy of the appeal, steps are being taken by the respondents to dispossess her and hence, she came forward to file the present writ petition. [b] WP.No.26365/2017:- The petitioner in the affidavit filed in support of this writ petition would aver among other things that he claims to be the owner of the land comprised in Survey No.78/1 situate at Sholinganallur Taluk, Vengaivasal Village, Vengaivasal Main Road, Santhosapuram, Chennai-600 073 and he would aver that he is in possession and enjoyment of the said property for more than 30 years and even prior to him, his predecessors in title have been paying property taxes and other taxes for the past 25 years and his possession had also been acknowledged by the concerned authorities by extending water supply and sewage connection, electricity supply connection etc. The petitioner has also been issued with Ration Card, Voter ID Card and Aadhar Card. [h] WP.No.26371/2017:- The petitioner in the affidavit filed in support of this writ petition would aver among other things that she claims to be the owner of the land comprised in Survey No.78/1 situate at Sholinganallur Taluk, Vengaivasal Village, Vengaivasal Main Road, Santhosapuram, Chennai-600 073 and she would aver that she is in possession and enjoyment of the said property for more than 30 years and even prior to her, her predecessors in title have been paying property taxes and other taxes for the past 25 years and her possession had also been acknowledged by the concerned authorities by extending water supply and sewage connection, electricity supply connection etc. The petitioner has also been issued with Ration Card, Voter ID Card and Aadhar Card. [m] WP.No.26374/2017:- The petitioner in the affidavit filed in support of this writ petition would aver among other things that she claims to be the owner of the land comprised in Survey No.78/1 situate at Sholinganallur Taluk, Vengaivasal Village, Vengaivasal Main Road, Santhosapuram, Chennai-600 073 and she would aver that she is in possession and enjoyment of the said property for more than 30 years and even prior to her, her predecessors in title have been paying property taxes and other taxes for the past 25 years and her possession had also been acknowledged by the concerned authorities by extending water supply and sewage connection, electricity supply connection etc. The petitioner has also been issued with Ration Card, Voter ID Card and Aadhar Card. The petitioner would also aver that to her shock and surprise, she has been issued with the notice under section 6 of the Tamil Nadu Land Encroachment Act, 1905, alleging that she has encroached upon the land classified as Meikkal Poramboke in S.No.78/1 admeasuring to an extent of 00068 sq.m. and put up a residential premises with a sheet-like structure on the roof and challenging the legality of the same, she filed an appeal under section 10 of the Tamil Nadu Land Encroachment Act, 1905, to the 1st respondent along with the petition for stay and in spite of pendancy of the appeal, steps are being taken by the respondents to dispossess her and hence, she came forward to file the present writ petition. 4. Mr. 4. Mr. R. Bharanidharan, learned counsel appearing for the petitioners on instructions, would submit that the petitioners are encroachers on the public land and their predecessors in title had put up superstructures and using the same for commercial entities and also residing in a portion of the premises for quite a long time and all the properties have also been subjected to statutory levies and the occupants/petitioners have also been issued with Voter ID Cards and the premises have also been provided with water supply and sewage connection as well as electricity service connection and they also moved the concerned authorities for issuance of pattas and the said applications are pending consideration and nearly after 30 years, steps are being taken by the revenue authorities to evict them by resorting to the provisions of the Tamil Nadu Land Encroachment Act, 1905, and challenging the same, appeals have also been filed before the Collector of Kancheepuram District, the 1st respondent herein, under section 10 of the said Act along with petitions for stay and appropriate directions may be issued either to the 1st respondent or to the official who has been delegated with such power, to take up the petitions for stay and give a disposal and thereafter, the main appeals itself and to dispose of the same on merits and in accordance with law and till such time, further proceedings including steps to be taken to dispossess them from the premises in question, may be deferred. 5. Per contra, Mr. A.N. Thambidurai, learned Special Government Pleader appearing for the respondents 1 to 5 would submit that admittedly, all the petitioners and prior to them, viz., their predecessors in title, have been termed as encroachers and the superstructures put up by them, are also wholly unauthorised and taking into consideration, all the relevant facts and circumstances, actions have been taken strictly in accordance with law for which the petitioners cannot express any grievance and prays for dismissal of these writ petitions. 6. In response to the said submission, the learned counsel for the petitioners has invited the attention of this Court to the order dated 24.08.2017 made in WP No. 22711/2017 [P. Ramamurthy Vs. 6. The Tahsildar, Sholinganallur Taluk, Chennai-119 and 2 others] and would submit that in similar facts and circumstances, this Court has granted liberty to the petitioner therein to file an appeal under section 10 of the Tamil Nadu Land Encroachment Act, 1905, with a further direction to give a disposal in accordance with law and also directed the concerned revenue official to defer the proceedings and prays that similar orders may be passed. 7. This Court has considered the rival submissions and also perused the materials placed before it. 8. A perusal of the typed set of documents filed in support of these writ petitions would reveal a shocking and sorry state of affairs. Admittedly, the petitioners are ranked encroachers and however, the concerned revenue officials have failed to take action at the relevant point of time and therefore, allowed them to perpetuate the illegality and the petitioners/their predecessors have, not only stopped with the illegal act of encroachment ; but also got emboldened on account of the inaction on the part of the revenue officials as well as the Local Body officials and proceeded to construct palatial superstructures, without any authorisation or planning permission and also leased out the same for commercial purposes. It appears that it was/is a deliberate and wilful act on the part of the revenue officials as well as the Local Body officials as to the non-taking of any action to abate such illegalities. 9. The petitioners challenging the initiation of action under the provisions of the Tamil Nadu Land Encroachment Act, 1905, had filed appeals by invoking section 10 of the said Act and pending disposal of the same, had also filed petitions for stay and prayed for deferment of the proceedings under the said Act till the disposal of the appeals. 10. 9. This Court, in the light of the above facts and circumstances, dispose of the above writ petitions in the following manner:- The respondents shall cause inspection of the entire area in question and identify the encroachers as well as the unauthorised/deviated constructions and take necessary and appropriate action within a period of ten weeks from the date of receipt of a copy of this order and file a COMPLIANCE REPORT to this Court. Insofar as the petitioners/encroachers are concerned, the photographs appended to the typed set of documents would disclose that most of the structures have been leased out for commercial purposes and therefore, the electricity connection given to those premises is to be disconnected forthwith. The 1st respondent District Collector or the delegated official is directed to entertain the appeal petitions filed by the petitioners, if the papers are otherwise in order and the said official, shall take up the petitions for stay at the first instance and give a disposal in accordance with law within a period of two weeks from the date of entertainment of the appeal petitions and till such time, shall defer further proceedings in terms of the impugned notices issued under section 6 of the Tamil Nadu Land Encroachment Act, 1905, and take up the appeal petitions and give a disposal in accordance with law within a period of eight weeks from the date of disposal of the petitions for stay and communicate the decision taken, to the petitioners as well as to the Local Body. The petitioners, till the disposal of the appeal petitions by the 1st respondent or the delegated official, shall not alter the physical features of the properties in question and shall not create any third party rights in respect of the lands and superstructures in question. The Administrative Department of the Government is directed to identify the officials concerned as to the continued laxity and exhibition of callousness and apathy in performing/discharging their official duties and neglect in protecting the assets of the Government and initiate appropriate Departmental and Criminal action and also file a Status Report. No costs. Consequently, the connected miscellaneous petitions are also closed. 10. Post the above writ petitions on 20.12.2017 for filing of the Compliance Report as well as the Status Report by the respondents as well as by the Administrative Departments of the Government.
