JUDGMENT : 1. Advertisement (Annexure-C) was issued inviting applications inter alia for the post of Anganwadi Workers on honorarium basis for Anganwadi Centres Panchayat Pogal Lower, Mohallah Adhal, Ward No.1 besides other centers. As per conditions stipulated in the advertisement, a person in order to be eligible was required to possess minimum qualification of Matric and in case, a candidate with Matric qualification was not available, then a Middle pass candidate was eligible, secondly only candidates residing in the concerned Panch Constituency Ward were eligible to apply. 2. Learned counsel for the petitioner by relying on the annexure attached to the objections filed by the petitioner to the application for vacation of stay filed by the private respondents, contends that in terms of the policy applicable, preference is to be given to a candidate belonging to BPL category in the selection for the post of Anganwadi Worker. Learned counsel further contends that as per Annexure-A, the petitioner is a resident of a backward area while as per Annexure-B, the petitioner is 12th pass and is also permanent resident of Village Pogal, Tehsil Banihal, District Doda as per Permanent Residence Certificate (PRC) i.e., Annexure-B issued by the Tehsildar Banihal and further that as per the select list, respondent No.6, who is only 10th pass and belongs to the General Category, has been shown to be selected (Select list i.e. Annexure-G) despite the fact that respondent No. 6 is not resident of Pogal Lower Panchayat Mohallah Adhal Ward No.1. 3. Learned counsel further contends that objections (Annexure-L) were filed by the petitioner to the selection of respondent No.6 before the District Social Welfare Officer, Ramban i.e. respondent No.2 and receipt in respect thereto, is also attached alongwith but the objections have not been decided till date. 4. Learned counsel for respondent No.6, on the other hand, states that the petitioner is not the resident of the locality, for which the post in question has been advertised. 5. Writ petition is of the year 2008. Objections have not been filed by the official respondents till date. A perusal of the Court file reveals that there is a stay operating against selection and appointment of respondent No.6 vide order dated 11.10.2008. In the circumstances, it would be futile to keep the writ petition pending any further to grant opportunity to the official respondents to file objections. 6.

In the circumstances, with the consent of counsel for the parties, writ petition is taken on board and is disposed of by directing respondent No.2 to consider and decide the objections (Annexure-L) filed by the petitioner in accordance with the rules and regulations applicable by passing a speaking order within a period of eight weeks from the date of receipt of certified copy of this order. It would be open to the parties to submit written submissions/evidence regarding respective claims before respondent No.2, who shall consider and take the same also into account while deciding the objections filed by the petitioner. Needless to mention, respondent No.2 shall take into account all documentary evidence as has been placed on record by the parties in the instant writ petition or as may be produced henceforth before respondent No.2. Writ petition along with connected MPs is disposed of with the aforementioned directions.
