ORDER : Ashutosh Kumar, J. Crl. MB No. 658/2017(suspension) 1. The appellant/applicant seeks suspension of sentence during the pendency of the appeal. The appellant/applicant has been convicted under Sections 304, II read with Section 34 IPC and has been sentenced to undergo RI for 7 years and to pay a fine of Rs. 2,50,000/- to the family of the deceased. 2. It has been submitted on behalf of the appellant/applicant that he has remained in jail for about three years by now, which period is inclusive of the remissions earned by him. 3. It has also been submitted that the petitioner has been suffering from many ailments. This Court had called for a report from the Jail Superintendent regarding the status of health of the appellant/applicant. The report received indicates that the appellant is a known case of CAD with CABG, Gall Stone with Hypertension and Hernia. 4. Learned Counsel for the appellant has also drawn the attention of this Court to various orders passed by different Benches of this Court, in the past, whereby the appellant was released on interim bail to undergo surgery for his ailments. 5. This is an appeal of the year 2015 and it has been submitted that there is no possibility of the appeal being finally heard in the near future. 6. Considering the facts and circumstances, and taking into the account the period of custody, the health of the appellant, his satisfactory conduct in Jail and the near impossibility of the appeal being heard in the near future, this Court is inclined to suspend the sentence of the appellant, during the pendency of the appeal. 7. The appellant is directed to be released on bail on his furnishing a bond in the sum of Rs. 10,000/with two sureties of like amount to the satisfaction of the trial Court. It is however made clear that the appellant must make himself available at the time of hearing of the appeal. The application is disposed of.
