JUDGMENT : 1. The relief sought for in this writ petition is for a direction to direct the respondents to consider the petitioner for the post of Headmaster, High School or P.G. Assistant by way of recruitment by transfer, by treating the petitioner as member of the Tamil Nadu School Educational Subordinate Service Rules in view of the G.O.Ms.No.7, Education, dated 04.01.2000 and post the petitioner as Headmaster or as P.G. Assistant with service and monetary benefits. 2. The learned counsel appearing on behalf of the writ petitioner states that the writ petitioner was initially appointed as Vocational Instructor in Computer science at Government Higher Secondary School, Namakkal on 01.09.1988. His services were regularized through order dated 31.05.1997 by the Joint Director of School Education, with effect from 16.10.1992. Thereafter, the petitioner was awarded with the post of Vocational Instructor in Computer Science in order dated 21.05.2008. However, the claim of the writ petitioner for promotion to the post of Headmaster High School or P.G. Assistant by way of recruitment by transfer, in accordance with the Government Orders has not been considered. 3. The learned counsel appearing for the writ petitioner states that the Vocational Instructors Computer Science are also to be considered as a cadre both from the Tamil Nadu School Educational Subordinate Service Rules and they are also eligible for promotion to the post of Headmaster or P.G. Assistant. However, it is for the respondents to consider these aspects in accordance with the rules. 4. Thus, without going into the merits of the matter, the first respondent is directed to consider the representation submitted by the writ petitioner on 13.12.2009 and pass orders on merits, within a period of twelve weeks from the date of receipt of a copy of this order. The writ petitioner is directed to enclose the copy of the representation and the relevant Government Orders along with the order passed in this writ petition. 5. Accordingly, the Writ Petition stands disposed of. However, there is no order as to costs.
