According to the petitioner, after passing three years Post Graduation Course in Department of Community Medicine from Devi Ahilya Vishwa-vidyalaya, Indore, he gave a bond that after Post Graduation Degree Course, he will work for a period of one year in Government Service and in case for some reason, he fail to do the same, then he will pay Rs.10,00,000/- (Rupees ten lacs) to the Government. In pursuance to the aforesaid bond, he was appointed on 12.1.2017 (Annexure P-5) to work at Chief Medical and Health Officer, Ujjain. On 25.1.2017 (Annexure P-9), he submitted his joining at Ujjain. He, without challenging the validity of rule 11 of Madhya Pradesh Medical and Dental Post Graduate Course Entrance Rules, 2013, filed the present writ petition and prayed for issuance of writ of mandamus, directing the respondents to return all his original documents. 3. It is submitted that the petitioner will complete his one year service on 24.1.2018 and in between he is applying for appointment at number of places and all those places require original documents, which are at present are lying with the respondents, and therefore, the respondents be directed to return the original documents to him, so that he may produce all those documents to the authorities concerned at the time of his appointment. He has also drawn our attention to Annexure P-10 and Annexure P-11 and submitted that in those matters, interim protection was granted to the writ petitioners therein, restraining the respondents from taking any coercive action in the matter to compel the petitioners therein to submit the bonds, as stipulated in the impugned notification. With the aforesaid, learned counsel for the petitioner has submitted that the original documents be returned to the petitioner. 4.

A detail reply has been filed by the respondents, stating that in the present case, the bond has been furnished by the petitioner in the year 2013 and as per bond, he was ready to work for a period of one year at Government Hospital, and therefore, on 12.1.2017 his appointment was made at Ujjain District. In pursuance to the aforesaid appointment, the petitioner submitted his joining on 25.1.2017 and is working there. As he cannot be appointed to some other place up to 24.1.2018, and therefore, no direction can be issued to the respondents to return the original documents to the petitioner, subject to his furnishing bond in the form of an affidavit to the effect that in case, the writ petition filed by the petitioner is dismissed or in the event of requirement, as mentioned in the bond is to be executed, the petitioner shall undertake to deposit the amount as per the bond in one installment. Subject to the aforesaid, the documents has been returned to the petitioners in the writ petitions which are pending at Principal Seat, Jabalpur. 5. In the present case, in compliance to the Madhya Pradesh Medical and Dental Post Graduate Course Entrance Rules, 2013, the petitioner furnished a bond and thereafter he is working at Ujjain, and therefore, no such direction, as prayed for, is required to be issued, but considering the fact that in the meanwhile, the petitioner is free to apply for his appointment in any other institution/organization and if he is selected in the institution/Government organization/public sector/corporation and if original documents are required, then the respondent/State of MP shall issue certificate to the effect that all photocopies of the documents, which have been filed by the petitioner, are correct and as his period of one year's service has not been completed, and therefore, the original documents will be released only after one year from the date of completion of his service and they have no objection for appointment of the petitioner in any other organization, after expiry of one year. 6. With the aforesaid direction, Writ Petition No.1332/2017 is disposed of.
