JUDGMENT : 1. When the matter was taken up today, learned counsel for the petitioners submitted that the Commissioner/Secretary, Housing and Urban Development Department has appointed Commissioner, Municipal Corporation, Jammu as Inquiry Officer. However, despite opportunities being granted on 26.05.2017 and 04.07.2017, the status report is not being filed on behalf of the respondents. 2. Mr. S S Ahmed, learned counsel for the petitioners submits that in the preliminary inquiry report, the officers who have been found guilty of irregularities are still occupying their posts against whom the inquiry is contemplated. Mr. S S Ahmed, further submits that the status report which may be filed on behalf of the Housing and Urban Development Department may indicate whether the Commissioner/Secretary is contemplating to shift the delinquent officers in order to ensure fair and impartial inquiry. 3. At this stage, Mr. S S Nanda, learned Sr. AAG for R-7, once again prays for adjournment so as to enable him to file the status report. Four weeks’ further time is granted to Mr. S S Nanda, learned Sr. AAG to comply with the order dated 26.05.2017 failing which this Court shall be constrained to take coercive action against the respondents. 4. Mrs. Seema Shekhar, learned Sr. AAG for respondents No. 3 and 5 prays for and is granted four weeks’ time to file the status report on behalf of the General Administration Department. 5. Mr. H A Siddiqui, learned Sr. AAG for respondent No.6 prays for and is granted four weeks’ time to file the status report on behalf of the Department of Law And Parliamentary Affairs. 6. Mr. Vishal Bharti, Dy. AG for respondent no.8 prays for and is granted four weeks’ time to file the status report on behalf of Social Welfare Department. 7. Mr. Raman Sharma, learned Dy. AG for respondent no.9 prays for and is granted four weeks’ time to file the status report on behalf of Commissioner, Vigilance-respondent No.9. 8. Office is directed to reflect the name of Mr. Raman Sharma, as counsel for the respondent no.9. 9. List again on 11.09.2017.
