ORDER Anant Bijay Singh, J. – The petitioner is apprehending his arrest in connection with Garhwa P.S. Case No. 471 of 2016, corresponding to G.R. No. 2158 of 2016 for the offence registered under sections 27(b) (ii) of the Drugs Cosmetic Act, 1940 and Rule 1945. 2. Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in this case. It is further submitted that the petitioner is not running the shop though the said shop was run by his brother Dr. N.K. Biswas and after his death the same was closed. 3. Learned A.P.P opposed the prayer for anticipatory bail. 4. Be that as it may, the above named petitioner is directed to surrender in the Court below within four weeks from the date of this order and in the event of his arrest or surrender the Court below shall enlarge the above named petitioner on bail on furnishing bail bond of Rs. 10,000/- ( Rupees ten thousand), with two sureties of the like amount each to the satisfaction of the court of learned C.J.M, Garhwa, in connection with Garhwa P.S. Case No. 471 of 2016, corresponding to G.R. No. 2158 of 2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C , 1973and also subject to the condition that petitioner shall deposit Rs. 8,000/in the court below on the date of his surrender. However, deposition of aforesaid amount would be subject to the result of the case.
