ORDER : The review petitioners are the members/office bearers of the first respondent-association. It is their case that behind their back, a joint memo was filed by the parties to the writ petition in W.P.No.37937/2013 under Order 23 Rule 3 of the CPC. The matter was accordingly compromised and the writ petition was disposed of on 27.1.2015. It is contended that this order has seriously jeopardized their interest. 2. I have heard the learned Counsel for the parties. 3. The review petitioners are not parties to the writ petition. A joint memo was filed by the parties to the writ petition and the said joint memo was taken on record and the writ petition was disposed of in terms of the joint memo. Having perused the materials on record, I am of the view that it is just and proper to hear the review petitioners before recording the compromise. 4. Therefore, the review petitions are allowed. The order dated 27.1.2015 in W.P.No.37937/2013 is hereby recalled and the writ petition is restored to file. Post W.P.No.37937/2013 before the Court having roster.
