ORDER : 1. Writ petition has been filed seeking the following relief : i. Writ of Prohibition restraining the respondents from replacing the petitioner for taking away the ration tickets from the area of the petitioner and granting a Fair Price shop dealership to any other person arbitrarily. ii. Writ of Mandamus commanding the respondents to permit the petitioner as a ration dealers/fair price shop dealers smoothly without causing any hindrance and taking away the Rationees/RTS from the area of the petitioner. iii. Writ of Certiorari quashing the impugned Government Order No.137 FCS and CA of 2016 dated 02.09.2016 to the extent it pertains to the petitioner and hits his right to livelihood. Further to pass any other order or direction the Court deems fit. 2. Learned Sr. AAG has referred to the stand of the respondents in preliminary objections in para No.C that no new fair price shop has been sanctioned in the area of the petitioners vide Government Order No.137-FCSCA of 2016 dated 02.09.2016, as such, the writ petition is mis-conceived and is liable to be dismissed. 3. Learned counsel for the petitioner, on the other hand, states that in view of categoric stand of the respondents in the preliminary objections as referred to above, he does not press the instant writ petition at this stage. However, liberty may be granted to the petitioner to file fresh writ petition, if the circumstances of the case so warrant. 4. Statement of learned counsel for the parties is taken on record. In view thereof, the writ petition is disposed of as not pressed with liberty as prayed for.
