JUDGMENT : 1. After hearing learned counsel for the parties, it transpires that although the petitioners-students have undergone practical training of three months in Government Hospital, Gandhi Nagar Jammu from 2nd of February, 2017 to 2nd of May, 2017, yet they have not been allowed to participate in the examination for various paramedical courses being conducted by the Paramedical Council, J&K State, Government Medical College, Jammu on account of non-registration of the petitioners-students by the New Modern Paramedical Institute, Sector-D, Sainik Colony, Jammu i.e respondent No.5. 2. Learned Sr. AAG states that the examinations have already commenced and one examination already stands conducted on 23.07.2017 and second examination is scheduled for 30.07.2017. Learned Sr. AAG further states that the purpose of registration is to enable the Paramedical Council to ascertain as to whether the Institute possesses the requisite staff, infrastructures, laboratories, training equipments as well as to verify the age and other eligibilities like qualification etc., requisite for admission of a candidate in the post concerned and that in the absence of respondent No.5 having registered the petitioners-students with respondent No.2, it would not be possible to ascertain the eligibility of the petitioners-students in question. That apart, a number of question papers printed is limited and at this stage, it would not be possible to get fresh question papers printed. Learned Sr. AAG states that appropriate course of action would be that the petitioners-students represent to the Institute, where they claim to have been admitted to move an appropriate application before respondent No.2 giving complete particulars of the students admitted by respondent No.5 for registration with respondent No.2 and on receipt of the application, complete in all respects, respondent No.2 would consider the claim of the petitioners for registration and if they found eligible, would take steps to ensure that no prejudice is caused to the petitioners on account of their not being able to appear in the examination which was scheduled for 23rd July, 2017 and 30th July 2017 respectively. Writ petition is taken on board and with the consent of learned counsel for the parties, is disposed of by granting liberty to the petitioners to take up the matter with respondent No.5 to submit an application to respondent No.2 for registration of the petitioners admitted by respondent No.5 in its different paramedical courses. In the eventuality of an application, complete in all respects as per rules being made by respondent No.5 to respondent No.2 for registration of the petitioners, respondent No.2 would as expeditiously as possible process the claim of respondent No.5 for registration of the petitioners to various paramedical courses in accordance with rules and regulations applicable and in case the petitioners are found fulfilling the parameters for registration, would register the petitioners and take steps to ensure that no prejudice is caused to them on account of their not being able to appear in the examination which was scheduled for 23rd July, 2017 and 30th July 2017 respectively. Needful be done as expeditiously as possible. 4. With the aforementioned directions, writ petition is disposed of.
