JUDGMENT : 1. In compliance of order dated 12.07.2017, Mrs. Seema Shekhar, Sr. AAG, has filed compliance report insofar as it pertains to the direction No. 12 contained in order dated 05.06.2017. However, Mr. S. S. Nanda, Sr. AAG, submits that the directions contained in paragraph No. 9 and 10 have already been complied with by the Commissioner/Secretary, Housing and Urban Development Department by submitting the compliance report. 2. We are not inclined to accept the aforesaid submission as the compliance report filed by Mrs. Seema Shekhar, Sr. AAG on behalf of Commissioner/Secretary to Government Housing & Urban Development Department pertains to the area of river, which is not covered in respect of the revised proposal as is required to be sent to the Central Government. The directions contained in paragraph Nos. 9 & 10 of order dated 27.04.2017 pertain to STPs, which are under construction and operational. 3. In the circumstances, we deem it appropriate to appoint a Committee of Advocate Commissioners and one Officer from the Pollution Control Board, Jammu, who shall be an expert in the field, to inspect the site and to submit its report with regard to the directions issued in paragraphs 9 and 10 vide order dated 27.04.2017. 4. We, accordingly, request Mr. Sunil Sethi, Sr. Advocate, Mr. C. M. Koul, Advocate and an Officer of Pollution Control Board, Jammu, who shall be expert in the field, to visit the site and to submit report within a period of one week from today. The Committee shall visit the site on 31.07.2017 at 4.00 pm. On the aforesaid date, Commissioner, Municipal Corporation, Jammu shall remain present at Bhagwati Nagar, Jammu. 5. Mrs. Seema Shekhar, Sr. AAG, submits that revised proposal with regard to setting up of STPs shall be forwarded to the Central Government within a period of four weeks from today. 6. In compliance of order dated 05.06.2017, Mrs. Seema Shekhar has filed Action Taken Report, in which it is stated that in Srinagar, out of 19 Pollution Checking Centers, 04 Pollution Checking Centers were found working satisfactorily and remaining Pollution Checking Centers are closed or not running properly for different reasons.

In compliance of order dated 05.06.2017, Mrs. Seema Shekhar has filed Action Taken Report, in which it is stated that in Srinagar, out of 19 Pollution Checking Centers, 04 Pollution Checking Centers were found working satisfactorily and remaining Pollution Checking Centers are closed or not running properly for different reasons. In Jammu, it is pointed out that out of 19 Pollution Checking Centers, 10 were found working satisfactorily and in the remaining 9 cases, the operators did not have the prescribed qualification, which is Diploma in Auto/Mechanical Engineering or ITI in Motor Mechanic/Auto Engineering/Diesel Mech./Tractor Mech. with one year experience as per the Government guidelines. She further submits that suitable action against the delinquent officials shall be taken for making Pollution Checking Centers operational in accordance with law. Let status report in this regard be filed on the next date of hearing. 7. Mrs. Sindhu Sharma, ASGI may also file status report within a period of four weeks. 8. The compliance report filed on behalf of Mr. W. S. Nargal, Sr. AAG in terms of order dated 05.06.2017 is taken on record. 9. List the mater in the week following next. 10. Let a copy of this order be supplied to the learned counsel for the parties and each of the Committee members under the seal and signatures of the Bench Secretary.
