JUDGMENT : This appeal is before us to examine correctness of the order dated 20.03.2014 passed by learned Single Bench in batch of writ petitions led by S.B. Civil Writ Petition No.6543/2009 (Smt. Anil & Ors. Vs. State of Rajasthan & Ors.). 2. By the judgment impugned, learned Single Bench directed the respondents to continue the petitioners therein as Auxiliary Nurse Midwife without insisting upon them to execute a fresh annual contract. A further direction was given to consider case of the petitioner for regularization in service. 3. At the threshold, it is submitted by learned counsel appearing on behalf of respondent-petitioner that the appellant-respondent after disposal of the writ petitions conducted a process of selection for the purpose of recruitment to the post of Auxiliary Nurse Midwife as well as Women Health Worker in the pay band of Rs.5,200-Rs.20,200/- with grade pay of Rs.2,800/-. The respondent-petitioner faced the process of selection and has also been selected and appointed on the post aforesaid. 4. In view of the appointment already given as per learned counsel, the appeal has become infructuous. Learned counsel appearing on behalf of appellant does not dispute the position stated above. In view of it, the appeal is dismissed.
