JUDGMENT : Notice. 1. Mr. Ahtsham Bhat, Government Advocate waives notice on behalf of the respondents and with the consent of learned counsel for the parties, the matter is heard finally. 2. In this petition, the petitioners inter alia seek a writ of mandamus commanding the respondents to consider the case of the petitioners for grant of benefit of SRO 149 of 1973 dated 07.04.1973 in light of the judgment dated 08.05.2017 passed by a Division Bench of this Court in a bunch of writ petitions lead case being SWP No. 809/2001. 3. When the matter was taken up today, learned counsel for the petitioners submitted that the writ petition be disposed of with a direction to respondent No. 1, namely, Principal Secretary to Government, Power Development Department, Jammu and Kashmir to consider the case of the petitioners in the light of Division Bench judgment dated 08.05.2017 (supra) by a speaking order. 4. On the other hand, learned Government Advocate submits that suitable action with regard to the claim of the petitioners shall be taken in accordance with law. 5. In view of the aforesaid submissions and in the facts of the case, this writ petition is disposed of with a direction to respondents (competent authority) to consider the claim of the petitioners for grant of benefit of SRO 149 of 1973 dated 07.04.1973 under rules also having regard to the judgment dated 08.05.2017 (supra) within a period of two months from the date of receipt of a certified copy of this order. Needless to state that in case the petitioners are found entitled to the benefit, the same shall be extended to them. It is made clear that this Court has not expressed any opinion on merits of the case. 6. With the aforesaid directions, writ petition along with connected MP stands disposed of.
