ORDER : This criminal misc. petition under Section 482 Cr.P.C. has been filed on behalf of the petitioner with a prayer for quashing the FIR No.84/2015 of Police Station Jamsar, District Bikaner. 2. The said FIR has been lodged at the instance of the respondent No.2, wherein he has alleged that the petitioner for the purpose of contesting election for the post of Sarpanch of Gram Panchayat, Bamblu has furnished certain false information in his nomination form and also submitted false educational certificates. It is also alleged in the FIR that the petitioner was not eligible for contesting the election for the post of Sarpanch of Gram Panchayat, Bamblu, however, his nomination form has wrongly been accepted by the returning officer. 3. Learned Public Prosecutor has submitted a factual report, wherein it is mentioned that the police after thorough investigation into the allegations levelled in the impugned FIR has found that the educational certificates furnished by the petitioner along with the nomination form have been duly issued by an institute situated in U.P., however, the police is investigating regarding recognition of the said institute. It is also mentioned in the factual report that on earlier occasion, the I.O. has already found that the allegations levelled in the FIR are not proved and the FIR has been lodged due to some misunderstanding. Learned Public Prosecutor has submitted that now the matter is being investigated by the Dy.S.P. on certain points and the investigation is likely to be concluded in a short span of time. 4. Having considered the facts and circumstances mentioned in the factual report, this Court is not inclined to interfere in this criminal misc. petition. 5. Hence, this criminal misc. petition is disposed of. Stay petition is also disposed of. 6. The factual report dated 17.2.2017 be taken on record.
