JUDGMENT : 1. Heard on I.A. (Criminal) No. 25/2017, which is an application for bail and suspension of sentence on behalf of applicants—(1) Borai Mia @ Giasuddin, (2) Badal Mia, (3) Siraj Uddin and (4) Taimush Uddin Barbhuiya. 2. According to the prosecution case, on 1.8.1994 at about 6 a.m. the applicants after forming an unlawful assembly along with other co-appellants in furtherance of their common object caused multiple injuries to Moyab Raja with deadly weapons, as a result of which, he died. 3. Joynal Haque Mazumdar (PW-11), son of victim Moyab Raja is an eye witness to the incident. He, soon after the incident around 11.30 a.m. went to Police Station Dholai and narrated the incident. This information was recorded as General Diary Entry No. 8. In the said report, although Joynal Haque named 7 persons as assailants of Moyab Raja, he did not name the present applicants. Much later at 9.15 p.m. another son Ainul Haque Mazumdar (PW-1) of Moyab Raja made ejahar at the same Police Station wherein he named the applicants also as assailants. 4. Whatever it may be, as the names of applicants did not find place in General Diary Entry No. 8, we deem it proper to grant bail to them. We accordingly direct that if applicants —(1) Borai Mia @ Giasuddin, (2) Badal Mia, (3) Siraj Uddin and (4) Taimush Uddin Barbhuiya furnish a solvent surety in the sum of Rs. 30,000/- each and execute a personal bond in the like amount to the satisfaction of the Sessions Judge, Cachar, the execution of sentence passed against them shall remain suspended and they shall be released on bail. 5. The application is allowed.
