AMOL RATTAN SINGH

body2017
JUDGMENT : AMOL RATTAN SINGH, J. 1. By this petition, the petitioner seeks quashing of FIR No.38 dated 21.8.2014, registered at Police Station Airport, Amritsar, for the alleged commission of an offence punishable under Section 420 IPC. 2. As per the allegation in the FIR, the petitioner arrived at the Amritsar Airport on 21.3.2012 and was found to be carrying a fake passport (as alleged). 3. Learned counsel for the petitioner submits that, as a matter of fact, the petitioner was an accused in a double murder case, in which he has been acquitted. 4. He also submits that, as a matter of fact, the petitioner had changed his name from “Ranjit Singh” to “Manjit Singh” in 2001 and as such, there is no question of him carrying a fake passport. 5. Having considered the aforesaid, as regards the petitioner being acquitted of the charge of murder against him, it is totally a different offence from the one alleged in the FIR in question in this petition, with regard to him allegedly carrying a fake passport. 6. As regards the petitioner having changed his name and therefore, possessing a passport in the name of Manjit Singh, that would be a matter of investigation and if eventually he is found to be innocent on the basis of evidence led before the Investigating Officer or the trial Court, as the case may be, the criminal proceedings would go on to their logical conclusion. Hence, in the opinion of this Court, the FIR can not be quashed at this stage. 7. Consequently, this petition is dismissed.
