JUDGMENT : Amol Rattan Singh, J. 1. Pursuant to the order dated 22.02.2017, the Superintendent of Police, Karnal, is present in Court today, on whose instructions learned State counsel submits that after the order of this Court, it has been enquired into and found that the Canadian visa stated to have been issued to the son of the complainant was never actually issued by the High Commission of Canada. 2. Learned counsel for the petitioner submits that at this stage he may be permitted to withdraw the present petition. Dismissed as withdrawn. 3. However, in view of the fact that not even a basic investigation was carried out till this Court has intervened, the Superintendent of Police, Karnal, submits that he would conduct an enquiry and take appropriate action as per law against any person, including the investigating officers concerned, if they are found guilty of either sheer negligence in their duties, or for not having conducted a fair investigation, possibly for any extraneous consideration. 4. It is expected that the statement made before this Court by the Superintendent of Police, Karnal, will be honoured by him and a genuine enquiry into the conduct of the investigating officer shall be carried out. 5. The observations made herein above, will obviously be subject to the enquiry to be carried out, though this Court has expressed its prima facie opinion at least with regard to the negligence in not even conducting basic investigation.
