JUDGMENT : 1. At the very outset, learned counsel for the petitioners prays for permission to withdraw the writ petition qua petitioner No.1 with liberty to file a fresh writ petition. Permitted to do so with liberty as prayed for. 2. In view thereof, writ petition stands dismissed as withdrawn qua petitioner No.1 with liberty as prayed for. 3. As regards petitioner No.2, learned counsel for petitioner No.2 contends that the post of Anganwari Worker in Anganwari Centre Dhar, Ward No.6 Panchayat Gundana District Doda was advertised vide Advertisement (Annexure-A) dated 24.04.2008. Despite respondent No.11 not belonging to Ward No.6 of the said village and petitioner No.2 belonging to Ward No.6, still it was respondent No.11, who was appointed as Anganwari Worker for Anganwari Centre Dhar, Ward No.6 Panchayat Gundana. 4. Petitioner No.2 represented against the illegal appointment of respondent No.11 by way of representation (Annexure-B) but no action has been taken on the same till date. 5. Per contra, Mr. Bharti, learned Dy. A.G, states that the representation was not addressed to the competent authority but to His Excellency, The Governor of Jammu and Kashmir with copy amongst other to the Director Social Welfare and D.C. Doda. 6. At this stage, learned counsel for petitioner No.2 states that since respondent No.11 has already resigned and vide interim order of this Court dated 30.11.2010, one post of Anganwari Worker for Anganwari Centre Dhar, Ward No.6 Panchayat Gundana, District Doda had been ordered to be kept vacant as the same had been vacated by respondent No.11, petitioner No.2 would be satisfied if the writ petition is disposed of by directing the District Program Officer, Doda to consider and decide the representation and to take appropriate action in respect thereto in accordance with law in view of respondent No.11 having filed an affidavit before the concerned authorities while submitting her resignation that she was not resident of Ward No.6 but resident of a different Ward and Panchayat. 7.

After hearing learned counsel for the parties, it is deemed appropriate to dispose of the writ petition by granting liberty to petitioner No.2 to address a copy of representation (Annexure-B) to the District Program Officer, Doda within one week from the date of receipt of certified copy of this order and the said District Program Officer, Doda, on receipt of the representation (Annexure-B) as is annexed alongwith this petition, would consider and decide the same in accordance with the rules and regulations and the factual position including by taking into account the affidavit submitted by respondent No.11 at the time of submitting her resignation and consider the claim of the aforesaid petitioner and in case, the petitioner’s stand is vindicated, then in that eventuality, the District Program Officer, Doda would take appropriate action by offering an appointment to petitioner No.2, if she is otherwise eligible and fulfills eligibility conditions and criteria as per the ICDS Scheme. Needless to mention, petitioner No.2 would also be at liberty to file a comprehensive representation in addition to the representation (Annexure-B) which is already on record. Needful be done as expeditiously as possible preferably within a period of three weeks. 8. With the aforementioned directions, writ petition along with connected MP stands disposed of.
