JUDGMENT 1. By way of this appeal, the State has challenged order dated 11.07.2007 whereby the learned Single Judge allowed the writ petition while following an order passed earlier by a Division Bench of this Court in Mangla vs. State of Rajasthan & ors 2007 (1) RRT 397, which was upheld by the Supreme Court. 2. Learned counsel for the appellant tried to contend that the issue is not covered by the decision in the case of Mangla (supra), however, no such argument was contended before the learned Single Judge. 3. In this view of the matter, we are of the opinion that the present appeal preferred by the State deserves to be dismissed. Practically, it was a consent order passed by the learned Single Judge and the same deserves no interference. 4. The appeal is devoid of merits and the same is dismissed. Appeal dismissed.
