B.S.WALIA

body2017
JUDGMENT : 1. Writ petition has been filed calling in question the action of respondent No.2 in excluding the name of the petitioner from the final select list on account of non-approval of the certificate of North Zone Senior Inter State Women’s Cricket championship as possessed by the petitioner as equivalent to national level championship. 2. It is contended that the name of the petitioner was unjustly excluded from the final select list of the candidates for the post of Physical Education Teacher District Cadre Jammu despite her being fully qualified for the same solely on account of non-approval of the certificate of North Zone Senior Inter State Women’s Cricket Championship as equivalent to the national level championship. 3. Mr. Sharma, learned Dy. A.G. has referred to the objections filed on behalf of respondent No.2 and contended that an Expert Committee of the Department was constituted to go into the matter in issue and found that the certificate possessed by the petitioner was valid/recognized and as such, 10 points earmarked for National participation were added to the total tally of points of the petitioner and the petitioner on account of adding of said points has made it to the select list. Consequently, the name of the petitioner has been recommended for selection and select list sent to Indenting Department vide Letter No.72-SSB of 2010 dated 26.05.2010 and in view thereof, grievance of the petitioner stands redressed because of her selection and the petition has been rendered infructuous. 4. Faced with the aforementioned stand of learned counsel for respondent No.2, learned counsel for the petitioner does not press the writ petition any further. 5. Accordingly, writ petition alongwith connected MP is disposed of as not pressed in view of the stand of learned counsel for respondent no.2 in the objections filed and as has been referred to above. Needless to mention, respondents shall take action in accordance with law and take the recommendation to its logical end as expeditiously as possible.
