ORDER : 1. Leave granted. 2. Heard learned counsel appearing for the parties and perused the record. 3. The order of detention dated 18.06.2016, has been issued by the Collector & District Magistrate, Chittoor, under section 3(1)(2) read with section 2(a) & 2(g) of A.P. Prevention of Bootleggers, Dacoits, Drug Offenders, Goondas, Immoral Traffic Offenders and Land Grabbers Act, 1986 (for short, the 'Act'), for a period of 12 months. 4. In the case of Cherukuri Mani W/o Narendra Chowdari vs. Chief Secretary, Government of Andhra Pradesh and Ors., 2015 (13) SCC 722 , this Court has held that such a detention order cannot be issued in the first instance for a period beyond three months. 5. Accordingly, we allow this appeal, and set aside the aforesaid detention order dated 18.06.2016 passed by the Collector & District Magistrate, Chittoor, as also the impugned judgment and order dated 4.1.2017 passed by the High Court of Judicature at Hyderabad in Writ Petition No.28748 of 2016. The detenu shall be set at liberty forthwith, if not required in any other case.
