JUDGMENT : Hemant Gupta, J. The present public interest litigation was initiated on the basis of the Newspaper Report Published in the Hindustan Times Patna dated 21st December, 2015 regarding menace of the stray dogs in the Patna Town. 2. Numerous counter affidavits have been filed by the State as well as the local bodies. However, a counter affidavit has been filed on behalf of the Under Secretary, Urban Development and Housing Department, Patna, wherein the list of actions to be taken in respect of menace of stray dogs has been delineated, which are appended as Annexure-A & B with the said counter affidavit. 3. The issue of menace of stray dogs is being considered by the Hon’ble Supreme Court in Special Leave to Appeal (C) No. 691 of 2009 (Animal Welfare Board of India Vs. People for Elimination of Stray Troubles & Ors.). 4. In view of the aforesaid developments before this court and when action plan has been prepared by the State, we find that no further action is required in the present public interest litigation. The same is disposed of with a direction to the State to take action as per the action plan prepared by them.
