ORDER : SUBHRO KAMAL MUKHERJEE, J. 1. The office objection is over ruled. 2. By consent of the learned Advocates appearing for the parties, the writ petition is taken up for preliminary hearing. 3. This is a writ petition seeking, in substance, quashing of a proceeding in a case being L.G.C. No. 35 of 2016, pending before the Special Court under the Karnataka Land Grabbing Prohibition Act, 2011. 4. The learned Advocate appearing for the writ petitioners, strenuously, argues that the issue has been settled, once for all, before the Civil Court, in which the Government was, also, a party. 5. We feel that the matter requires evidence. It will not be advisable, therefore, to quash the proceedings pending before the Special Court, at this stage. 6. We do not find any merit in the writ petition. The writ petition is dismissed. 7. We make no order as to costs.
