JUDGMENT Chandrashekhar, J. – The petitioners are seeking a direction for their appointment on the post of Driver (Constable). 2. Heard. 3. By Advertisement No.01/2010 applications were invited for appointment to the post of Driver (Constable) between 15.02.2010 to 25.02.2010. The petitioners are applicants from Hazaribagh district under OBC (Non-Homeguard) category, from where 47 vacancies were invited. The learned counsel for the petitioners submits that the petitioners having qualified in all the tests were duly selected, however, petitioner no.2 has finally not been appointed and petitioner no.1 who was provisionally appointed, has been dismissed vide order dated 01.10.2010. 4. In the counter affidavit, the respondents have taken a stand that there was serious discrepancy in the date of birth of the petitioners as recorded in the educational certificate and the driving license. It is stated that verification reports were sought from the District Transport Officer, Godda and Hazaribagh respectively by the Superintendent of Police, Chatra for verification of the driving license produced by the petitioners. In the verification reports, it was recorded that there is difference in date of birth recorded in certificate of educational qualification and driving license produced by petitioners. 5. The School Leaving Certificate of petitioner no.1 was issued on 29.07.2000 and it records his date of birth as 10.03.1982. The driving license which was issued on 06.07.2006 records his date of birth as 01.01.1986. Petitioner no.2 appeared in the Matriculation examination conducted in the year, 1995. The admit-card issued to him records his date of birth as 15.04.1980. However, in the driving license which was valid upto 26.10.2012 his date of birth is recorded as 09.11.1975. Advertisement for appointment of Driver (Constable) was issued in the year 2010. The petitioners have miserably failed to explain the above discrepancy in the aforesaid documents by any plausible explanation. In the aforesaid facts, the petitioners cannot seek appointment, may be, they have qualified in the tests conducted by the respondents for appointment of Driver (Constable). The learned counsel for the petitioners relied on " Kamta Pandey v. M/s BCCL through Chairman-cum-Managing Director, Dhanbad & Ors" reported in (2007) 3 JCR 681 (Jhr) (FB) which in peculiar fact of this case, is not applicable. 6. The writ petition, bereft of merit, is dismissed.
