ORDER : These petitions are filed under Section 25 of the Code of Civil Procedure, 1908, seeking transfer of Suit No.23 of 2015 and Suit No.964 of 2015 titled as “Sandeep Kumar Jaiswal Versus Smt. Ritwika Jaiswal” pending before the Court of Chief Judge family Court Gorakhpur, U.P. to the Court of District Court at Barasat, 24 Pargana (North), West Bengal. 2. Having heard learned counsel for the parties and having considered the facts circumstances of the cases, we deem it fit and proper to allow these transfer petitions. Accordingly, the Suit No.23 of 2015 and Suit No.964 of 2015 titled as “Sandeep Kumar Jaiswal Versus Smt. Ritwika Jaiswal” are ordered to be transferred from the Court of Chief Judge family Court Gorakhpur, U.P. to the Court of District Court at Barasat, 24 Pargana (North), West Bengal. 3. The Court shall ensure that proceedings are conducted in the Court in English language including discussions, recording of evidences, etc. as the respondent does not understand the Bengali language. 4. It will always be open to the Respondent-husband to approach the Trial Court seeking visitation rights including interim custody. 5. Let the records of these cases be transferred to the concerned court without delay. 6. The transfer petitions are allowed, accordingly.
