JUDGMENT : SUMAN SHYAM, J. 1. None appears for the writ petitioner on second call. 2. Heard Mr. S.P. Bhattacharjee, learned departmental counsel appearing for the Education Department, Assam. 3. In this writ petition a prayer has been made for issuance of a direction for provincialisation of the service of the writ petitioner in the post of Assistant Teacher (Hindi) in the Pub-Dhakuakhana Adarsha M.E. School. The learned departmental counsel submits that the Assam Venture Educational Institution (Provincialisation of Services) Act, 2011 has since been struck down by the Division Bench of this Court and therefore, the prayer made in the writ petition may not survive for consideration of this Court any further. 4. Be that as it may, it appears that the petitioner is not interested to pursue this writ petition any further. In view of the above, this writ petition stands dismissed for non-prosecution by granting liberty to the petitioner to apply for restoration of the writ petition by showing good cause if the same is advised.
