body2017
ORDER : No one has appeared on behalf of the respondent. 2. We have heard learned counsel for the appellants. 3. This appeal has been filed against the impugned order dated 16.05.2008 passed by the High Court of Punjab and Haryana at Chandigarh. The High Court issued a direction to the respondent i.e. the appellants herein to release the amount of Rs.11,67,260/- within a period of two weeks, and further pay interest from March, 2007 till the date of payment at the rate of 9%. 4. The respondent had filed the writ petition before the High Court seeking direction to release the investment incentive (Capital Subsidy) of Rs.14.07 lacs which was sanctioned vide letter dated 03.11.1997. The stand taken by the appellants was that the unit had remained closed, which was disputed by the respondent. The matter was heard by the High Court. Ultimately, the High Court took the view that the amount which was sanctioned vide letter dated 03.11.1997 was Rs.11,67,260/-. It was the conceded position before the High Court that the name of the petitioner (the respondent herein) in the list of beneficiaries for capital subsidy was figured at Sr.No.1289 and the same had already matured in March, 2007. Learned counsel for the appellants has further submitted that the amount of subsidy has already been paid along with the interest, which was paid subsequently. 5. In view of the above, we find no ground to interfere with the impugned order passed by the High Court. 6. The appeal is accordingly dismissed.
