JUDGMENT Anil Kumar Choudhary, J. – Apprehending his arrest the petitioner has moved this Court for grant of privilege of anticipatory bail in connection with Telaiya P.S. Case No.103 of 2017 registered under Section 18(c), 27(b) (ii), 29(d) of the Drug and Cosmetic Act, 1940. 2. Heard learned counsel appearing for the petitioner as well as learned Addl. P.P. for the State. 3. Learned counsel for the petitioner submitted that the petitioner is the compounder of private clinic of Dr. Narendra Kumar at Koderma and there is no allegation that the drug was sold across the counter or kept in a open shop. Hence no offence as alleged is made out. 4. Learned Addl. P.P. appearing on behalf of the State opposes the prayer for anticipatory bail of the petitioner and submits that case diary be called for. 5. Call for the case diary from the concerned trial court. 6. List this case on 12.07.2017. 7. Considering the submissions of counsels and the fact as discussed above, I am inclined to pass an interim order of anticipatory bail to the petitioner provisionally till 12.07.2017. In case of the petitioner being arrested by the police on or before 12.07.2017, he shall be released on bail provisionally on furnishing bail bond of Rs. 10,000/( Ten thousand) with two sureties of the like amount each to the satisfaction of the officer concerned in connection with Telaiya P.S. Case No.103 of 2017 (G.R. No.344 of 2017) subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure, 1973.
