AMOL RATTAN SINGH

body2017
JUDGMENT : AMOL RATTAN SINGH, J. 1. Pursuant to the orders dated 29.03.2017 and 06.04.2017, an affidavit of the Senior Superintendent of Police, Shaheed Bhagat Singh Nagar, has been filed in Court today by learned State counsel, which is taken on record. 2. Mr. Mehta further submits, on telephonic instructions from the SSP, that it has also been found out from the village of petitioner No.1, that he was never married prior to his marriage to petitioner No.1. However, as regards, petitioner No.2, Noorjot Atwal, she was earlier married to one Jasbir Singh son of Harbans Singh and as per the affidavit of the SSP, the enquiry conducted reveals that the marriage still subsists with no divorce having taken place. 3. Learned State counsel has also further submitted that petitioner No.2 is no longer residing in India. 4. This petition was filed by the petitioners seeking protection of life and liberty as they apprehended a threat thereto at the hands of respondents No.4 and 5, who were stated to be the parents of petitioner No.2. 5. The petition is consequently disposed of with a direction that any proceedings initiated by a competent person against the petitioners in view of the fact that petitioner No.2 is stated to have been married earlier and got married to petitioner No.1 without a divorce from her first husband, would not be barred by any order passed by this Court, in these proceedings.
