S. G. VAISAKHAN v. KERALA PUBLIC SERVICE COMMISSION

2017-07-04

L.NAGESWARA RAO, S.A.BOBDE

body2017
ORDER 1. Leave granted. 2. Having heard learned counsel appearing for the parties and upon perusal of the record, we find that the only ojection to the candidature of the appellants is that during the written test, the appellants did not have current and valid driving licences because the same have expired. 3. It is not disputed that on the other relevant dates, such as, the last date for receipt of application and even during the practical test, the appellants had current and valid driving licences. 4. In these circumstances, we see no reason why the appellants ought to be denied the opportunity of being considered for appointment to the post of Police Constable Driver (Armed Police Battalion). 5. Hence, we allow this appeal and direct the Kerala Public Service Commission to advise the State Government accordingly. The State Government shall include the appellants' name in the rank list and act on the basis of the rank list.
