JUDGMENT Vijay Bishnoi, J. - This criminal misc. petition under Section 482 Cr.P.C., 1973 is filed by the petitioner being aggrieved with the order dated 29.01.2018 passed by the Judicial Magistrate, Sri Vijaynagar, District Sriganganagar in criminal case No.29/14 whereby, the application filed by the petitioner under Section 311 Cr.P.C., 1973 with a prayer for recalling respondent No.1 complainant Brij Lal for further cross examination has been rejected. 2. The petitioner is facing the proceedings under Section 138 of the Negotiable Instrument Act before the court below. The said proceedings are initiated at the instance of respondent No.1. The statements of the respondent No.1 were recorded before the trial court on 20.10.2016 and on the said date learned counsel for the petitioner before the court below had thoroughly cross examined him. Later on, on 04.01.2018 an application was moved on behalf of the petitioner before the court below with the contention that he has engaged a new counsel and as the earlier advocate did not produce some sale slips which were issued by the respondent No.1, therefore, for the purpose of producing those sale slips, one more opportunity be granted to him and the respondent No.1 be recalled for further examination. 3. The court below has rejected the said application while observing that the so called sale slips were in possession of the petitioner when the statements of respondent No.1 were recorded and simply because the petitioner has engaged a new counsel the application preferred by him under Section 311 Cr.P.C., 1973 for recalling the respondent No.1 cannot be granted. 4. Having heard learned counsel for the petitioner and after going through the impugned order, I do not find any illegality in the same. 5. Hence, this criminal misc. petition is dismissed. Stay petition also stands dismissed. Petition Dismissed.
