JUDGMENT : Dharam Chand Chaudhary, J. Learned amicus curiae and learned Addl. Advocate General as well as learned senior counsel for respondent No. 3 are in agreement that the complaint/petition addressed to the Chief Justice of this Court has not been processed as per the Himachal Pradesh High Court Public Interest Litigation Rules, 2010 before its registration as CWPIL and enlistment on judicial side in the Court. We also feel that no public interest is involved in this matter because complainants are none else but the staff of erstwhile Mohan High School Solan Brewery and the complaint is that retiral benefits such as leave encashment, gratuity and pension is neither sanctioned nor released to them. It can also be gathered from the record that few of them even have agitated this matter earlier also in civil litigation. 2. Anyhow, we dispose of this petition with a direction to the concerned branch of the Registry to process the complaint/petition strictly as per the provisions contained under the Rules ibid and ascertain that the petitioner/complainant is a genuine person and espousing the cause of general public. It is thereafter on obtaining orders from the competent authority under the Rules and after complying with all codal formalities, register the same as PIL and list in the Court as per the roster of Board. In the event of the petitioner/complainant is not found to be a genuine person or having failed to turn up to comply with the procedural requirements envisaged under the Rules to close the matter.
