JUDGMENT : MAHABIR SINGH SINDHU, J. 1. The present petition has been filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.215 dated 25.12.2014, registered under Sections 420, 465, 467, 468, 471 and 120-B of the Indian Penal Code, registered at Police Station Civil Lines Bathinda, District Bathinda. 2. Learned Counsel for the petitioner has fairly stated that in another case under Sections 363 and 366 of the Indian Penal Code, the petitioner stands convicted but he has already been released on bail. 3. It is contended by learned Counsel for the petitioner that the petitioner is in custody since 31.07.2017 and his co-accused Sukhjinder Singh has already been granted the concession of regular bail by this Court, vide order dated 23.01.2018 (Annexure P-3). 4. In view of the fact that the charges have already been framed by learned trial Court vide order dated 29.01.2018. The petitioner is in custody since 31.07.2017 and his co-accused has already been released on bail by this Court. This is only a magisterial trial to be conducted in the present case and as per the report submitted by the police under Section 173 Cr.P.C., 17 witnesses have been cited. Therefore, the trial will take a long time even after framing of the charges which are yet to be framed and thus the incarceration of the petitioner any further will not serve any purpose. Consequently, this petition is allowed. Petitioner-Dharminder Singh be admitted to bail on his furnishing bail bonds and surety bonds to the satisfaction of the learned trial Court.
