JUDGMENT Mr. Augustine George Masih, J.: (Oral) - The petitioner has approached this Court for grant ofconcession of regular bail in case FIR No.02, dated 03.01.2017, underSections 302, 307, 148 and 149 IPC and Section 3 of the Scheduled Castesand Scheduled Tribes (Prevention of Atrocities) Act, 1989, registered atPolice Station Bajakhana, District Faridkot. 2. As per the FIR, the role attributed to petitioner, Gurpreet Singh@ Soni is that he was armed with a wooden handle and he raised a lalkarathat in case anybody came forward, he will not be spared. This lalkara wasgiven by petitioner, Gurpreet Singh @ Soni after the husband of thecomplainant, Jaswinder Singh, had been attacked by one Ashwani Sharmaand Baljit Singh @ Balli son of Jaskaran Singh. The nephew of deceasedJaswinder Singh, husband of the complainant, when came forward onhearing the noise to rescue him, then Ashwani Sharma and Baljit Singh @Balli attacked him as well on his chest and other parts of the body. No overtact has been attributed to the petitioner except that he had given a lalkaraand was armed with a wooden handle. No injury has been attributed to himto any of the two persons. The petitioner was arrested on 04.01.2017 and isin custody since then. 3. Counsel for the State as also counsel for the complainant havevehemently argued that the petitioner is a henchman of the Baljit Singh,liquor Thekedar, who alongwith other co-accused gave merciless blowsupon deceased Jaswinder Singh and injured Devinder Singh. They contendthat the petitioner may not be granted the concession of regular bail. 4. I have considered the submissions made by counsel for theparties and also gone through the above allegations levelled against thepetitioner. Since the petitioner is in custody for more than one year and thetrial is not likely to conclude in near future, the petitioner is directed to bereleased on bail to the satisfaction of the trial Court, Faridkot. 5. The petition stands allowed.
