JUDGMENT : Rajesh Bindal, J. 1. The petitioner has approached this Court only for a direction that his documents may be verified as he was selected and found at Serial No. 1 in the provisional select list as Junior Pharmacist, District Cadre, Kupwara. 2. Learned counsel for the petitioner submitted that when the first provisional select list was notified, name of the petitioner was not there. However, on the representation received from Vicky Hans S/o Sh. Sat Pal, the list was revised. Fresh revised provisional list was notified on 23.01.2018 giving time to the candidates for verification of documents on 02.02.2018. In the revised provisional select list name of the petitioner was at Serial No. 1. It is claimed that the petitioner lives in the Border area where internet facility is either not available or there is lot of disturbance. Because of disturbance, the petitioner did not come to know about uploading of the revised provisional select list on the website of the Service Selection Board. He was informed about his selection in the revised select list by one of his friends. Immediately thereafter, the petitioner approached the Board and requested for verification of his documents. Letter dated 05.02.2018 was submitted. No action has been taken. 3. It was further submitted that none of the selected candidates in the Scheduled Caste category has joined and the posts are lying vacant. Had the petitioner come to know about his selection, he would have immediately responded to get his documents verified. There is no inaction on the part of the petitioner. The list was not published in the newspaper. It was uploaded only on the website of the Board. 4. Despite opportunities, respondents have not filed the objections. Learned counsel for the Board submitted that he had written three communications to the Board for filing objections but none has responded. 5. After hearing learned counsel for the parties and considering the fact that the petitioner is at Serial No. 1 in the revised provisional select list and the only delay on his part was that he could not get the documents verified on the date fixed for the purpose. The revised provisional select list was uploaded only on the website of the Board. The petitioner lives in a Border area where the internet facility is not regularly available. Immediately when the petitioner came to know about his selection he approached the Board. Application was not delayed as it was filed on 05.02.2018 whereas the date fixed by the Board for verification of the documents was 02.02.2018. It was also claimed that none of the candidates of the Scheduled Caste category had joined. 6. Keeping in view the aforesaid facts, in my opinion, this petition deserves to be allowed. Ordered accordingly. The Board is directed to verify the documents of the petitioner. The petitioner shall appear before the Secretary, Service Selection Board on 07.01.2019 at 11.00 AM for verification of his documents. In case the petitioner is found to be eligible after verification of the documents, necessary action for his appointment shall be taken within two weeks thereafter. 7. This petition is, accordingly, disposed of.
