ORDER 1. We have heard the learned counsels for the parties. 2. Leave granted. 3. Taking into account the period of custody suffered i.e. for over two and half years and the sentence awardable under Section 135 of the Customs Act, 1962, if the accused appellant is to be held liable and also the fact that the trial has not yet commenced we are of the view that the accused appellant is entitled to be released on bail. We order accordingly. The appellant shall be released on bail to the satisfaction of the learned trial Court in connection with Complaint No.1 of 2015. 4. The learned trial Court is free to impose appropriate condition(s) as it deems fit. The accused appellant shall deposit his passport before the learned trial Court which will be kept in custody of the learned trial Court till completion of the trial. 5. Consequently, the order of the High Court is set aside and the present appeal is disposed of in the above terms.
