ORDER 1. We have heard the learned counsels for the parties. 2. Leave granted. 3. Having regard to the basis on which the conviction of the accused appellant has been ordered by the learned trial Court and affirmed by the High Court we find no ground to interfere. However, taking into account the age of the accused appellant i.e. 62 years while upholding the conviction recorded under Section 304A/279 IPC we modify the sentence upheld by the High Court to one of rigorous imprisonment for six months and the sentence of fine is reduced to Rs.10,000/-(Rupees ten thousand) 4. With the aforesaid modification of the sentence, the appeal is disposed of. The accused appellant shall surrender forthwith before the concerned authority and serve out the remaining period of sentence.
