JUDGMENT Mr. Tejinder Singh Dhindsa, J. (Oral).:- The instant petition was preferred under Section 439 Cr.P.C. seeking interim bail for a period of 30 days to the petitioner so as to participate in the marriage ceremony of his sister, namely, Navneet Kaur. 2. Petitioner is an accused in FIR No.0955 dated 26.10.2017, under Sections 148/149/302 IPC, registered at Police Station Thanesar City, District Kurukshetra and is presently lodged in District Jail, Kurukshetra. 3. Interim bail for a period of 30 days is sought on the ground that marriage of the sister of the petitioner, namely, Navneet Kaur is fixed for 04.03.2018. 4. Notice of motion was issued on 21.02.2018. 5. Learned State counsel by way of response has filed in Court today an affidavit of Deputy Superintendent of Police, HQ, Kurukshetra dated 26.02.2018 along with a verification report of Sat Narain, ASI, Crime Branch-I, Kurushetra dated 26.02.2018. The same is taken on record. 6. Perusal of the response filed on behalf of the State would reveal that an exercise of verification has been done and it has been found that petitioner is the only son of his parents and he has two sisters. Marriage of the elder sister, namely, Navneet Kaur is fixed for 04.03.2018 and is to be solemnized at K.R. Palace, Kurukshetra. Father of the petitioner Sarabjeet Singh expired on 30.12.2012 and even a death certificate has been collected. In the response, it has been stated that grandfather of the petitioner, namely Kartar Singh is not residing in India and the petitioner is the only male member of his family available in India. 7. In the light of the verification report placed on record, prayer of the petitioner is allowed to the extent of grant of interim bail for a period of 10 days commencing w.e.f. 01.03.2018. 8. Present petition is partly allowed. Petitioner be enlarged on interim bail for a period of 10 days commencing from 01.03.2018 subject to satisfaction of the trial Court/Duty Magistrate concerned. 9. Petitioner would surrender before the Jail Authorities, District Jail, Kurukshetra on 11.03.2018 at 11 A.M. 10. A copy of this order be given to learned counsel for the petitioner under the signatures of the Bench Secretary. 11. Disposed of.
