JUDGMENT 1. Petitioner has filed this bail application under Section 439 Cr.P.C. 2. Criminal Case No.1072/2006, pending in Additional Chief Judicial Magistrate 9, Jaipur for offence under Sections 138 NI Act. 3. It is contended by counsel for the petitioner that the matter pertains to bail jump. It is contended that petitioner is aged 70 years and is sick. 4. Learned Public Prosecutor has opposed the bail application. His contention is that the matter pertains NI Act. The case was at final stage and was for recording of the statement of the accused- petitioner in the year, 2008. Petitioner remained absent and his bail bonds were forfeited, thereafter, he surrendered before the Court and again absented from the Court and has remained absent for last thirty days and was finally declared as an absconder. 5. I have considered the contentions. 6. Considering the contentions put forth by counsel for the state and taking note of the fact that the matter is at fag end of the trial, I am not inclined to allow the bail application. 7. This bail application is, accordingly, rejected. 8. Trial Court is directed to decide the case at the earliest.
