JUDGMENT Shree Chandrashekhar, J. – During pendency of the writ petition by an order dated 10.01.2008 legal heirs and successors of the petitioner no.1 were substituted (I.A. No.3036 of 2005). 2. The petitioners are aggrieved of order dated 10.03.2004 by which their application for recall of order dated 08.01.2003 has been rejected. 3. Contention raised on behalf of the petitioners is that without affording an opportunity to them issues in the suit were framed on 08.01.2003. 4. In its order dated 10.03.2004 the trial Judge has observed that the suit was posted for hearing on several occasions and parties were permitted to submit proposed issues for which the suit was posted on atleast 8 occasions and thereafter only the parties had submitted the proposed issues on 13.06.2002. Thereafter, the suit was posted on 04.07.2002, 08.07.2002, 19.07.2002, 26.07.2002, 07.08.2002, 26.08.2002, 05.09.2002 and 30.09.2002. Issues in the suit were settled by order dated 08.01.2003. 5. In the above facts, I am satisfied that the petitioners had sufficient opportunity to make submissions on the proposed issues. 6. Finding no infirmity in the impugned order dated 10.03.2004, the writ petition is dismissed. 7. Interim order dated 26.08.2004 stands vacated. 8. Let a copy of the order be transmitted to the learned trail court through FAX.
