JUDGMENT Deepal Maheshwari, J. - Heard learned counsel for the accused-petitioner as well as learned Public Prosecutor on the application for suspension of sentence. 2. Learned counsel for the petitioner submits that the accused petitioner is behind the bar since 3.4.2018. There is no other case pending against the petitioner except this present case. He was on bail during pendency of the appeal. He therefore, submits that sentence awarded to the accused-petitioner may kindly be suspended. 3. The petitioner has been convicted for the offence under section 138 NI Act and sentenced with a maximum of two years simple imprisonment along with fine as per judgment dated 3.4.2018 passed by learned Lower Appellate Court. 4. Learned Public Prosecutor and the counsel appearing for the complainant have vehemently opposed the prayer. 5. Without commenting upon the merits of the case and looking to the facts and circumstances of the case for consideration, I deem it just and proper to suspend the sentence awarded to the accused-petitioner. 6. In view of the above submissions, this Court thinks it proper and accordingly order to suspend the sentence subject to the condition that after 50% of cheque amount is deposited by the accused-petitioner before the trial court within a period of two weeks from today, the sentence passed by the learned trial court and affirmed by the learned ADJ No. 16, Jaipur Metropolitan, Jaipur vide his judgment dated 3.4.2018 passed in Criminal Appeal No.645/2017 against the accused-petitioner Bhupendra Singh Khangarot S/o Raghuveer Singh shall remain suspended till final disposal of present revision petition provided he executes a personal bond in the sum of Rs. 50,000/- along with two sureties in the sum of Rs. 25,000/- each to the satisfaction of the trial court for his appearance in this Court on 5.5.2018 and, as and when called upon to do so. 7. The amount deposited by the accused-petitioner may be disbursed to the complainant on moving application by him before the trial Court.
