JUDGMENT Shree Chandrashekhar, J. – Supplementary counter-affidavit dated 14.05.2018 filed on behalf of respondent no. 4 is taken on record. 2. In this affidavit it is stated that in the light of decision taken by the District Education Establishment Committee in its meeting held on 11.05.2018, the District Superintendent of Education, Simdega has issued office order dated 12.05.2018 pursuant to which the petitioner has submitted his joining. 3. In view of order dated 30.04.2018 pursuant to which the respondents have reinstated the petitioner in service, the impugned order dated 04.10.2016 stands quashed. 4. In so far as prayer for payment of salary to the petitioner from 29.12.2015 is concerned, the respondent-District Superintendent of Education, Simdega is directed to ensure payment of salary to the petitioner from the date of joining to 04.10.2016, the period during which the petitioner has admittedly worked, within four weeks. 5. For the period after 04.10.2016 till 11.05.2018, the period during which the petitioner was prevented from discharging his duty on account of the illegal order of termination, the petitioner shall submit an application before the competent-authority raising a claim for payment of salary for the above period. 6. The writ petition stands allowed, in the aforesaid terms.
