JUDGMENT Kailash Prasad Deo, J. – Heard learned counsel appearing for the petitioner and learned Addl. Public Prosecutor appearing for the State. 2. The petitioner, who is accused for the offence under Sections 306 of the Indian Penal Code, prays for anticipatory bail expressing apprehension of his arrest in connection with Bokaro, Sector IV P.S. Case No. 36 of 2018 corresponding to G.R. No. 439 of 2018, pending in the court of learned Additional Chief Judicial Magistrate, Bokaro. 3. Learned counsel for the petitioner Mr. Vikash Kumar has drawn attention of this Hon''ble Court towards the First Information Report where it has been specifically mentioned that the deceased has committed suicide at her parental house and not in her sasural. Learned counsel has submitted that there is no specific reason attributed against the petitioner that the petitioner has instigated the victim to commit suicide. 4. Learned counsel for the State has opposed the prayer for bail and submitted that since the petitioner was present along with the deceased-wife and as such this anticipatory bail application may not be allowed. 5. Be that as it may, since the investigation is not under Sections 302 or 304-B rather it is under Section 306 of the Indian Penal Code and no specific allegation has been attributed against the petitioner of instigating the victim, the petitioner, above named, is directed to surrender before the court below within three from today, and in the event of his arrest or surrender, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bokaro, in connection with Bokaro, Sector IV P.S. Case No. 36 of 2018 corresponding to G.R. No. 439 of 2018.
