JUDGMENT Mr. G.R. Moolchandani, J. - This petition is directed against charge-sheet no.2 dated 03.02.2010 filed in Session Case No. 26/2010 State v. Sushil & Others arising out of FIR No. 76/2009 dated 16.07.2009 registered with Police Station Mukandgarh, District Jhunjhunu for the offence punishable under Section 8/15 of the Narcotics Drugs & Psychotropic Substances Act coupled with Section 16/54 of the Rajasthan Excise Act. 2. Learned counsel for the petitioner has contended that the petitioners are valid license holders to vend lanced poppy heads and nothing incriminatory has been recovered from the premises of the license holders, the Investigating Agency acting in contravention of law and break opened locks of licensed premises of the petitioner/s malafidely and no unlawful recovery was made from the premises of the petitioner/s. Main allegations were against one Sushil Kumar and for non-adherence of mandatory procedure enumerated under NDPS Act, trial against Sushil Kumar has collapsed and the trial court has acquitted main accused Sushil Kumar s/o Rajendra Prasad on 13.09.2012. Drawing attention of the court towards license of petitioner/s, it has been contended that petitioner/s are valid license holders to sell lanced poppy heads, one of the petitioner Moti Ram has already died, petitioner Raj Kumar has wrongly been implicated and harassed, even the contents of FIR does not divulge any incrimination against the petitioner/s, so criminal proceedings against the present petitioner/s sub-judice before the court of District & Sessions Judge, Jhunjhunu in criminal case No. 26/2010 be quashed. 3. Indisputably co-accused Sushil Kumar has already been acquitted by the Court of Special Judge, NDPS Act Cases, Jhunjhunu vide Session Case No.26/2010 on 13.09.2012, arising out of the same FIR No.76/2009 registered with Police Station Mukandgarh, District Jhunjhunu, copy of the judgment placed on record, discloses that mandatory provisions were not adhered by the prosecution, even link evidence was lacking. Annexure-2 copy of license of the petitioner/s for retail vend of lanced poppy heads, depicts that both the licenses have been issued for 2009-10 in the names of Raj Kumar son of Sobhanand and Moti Ram son of Birda Ram. 7. Exhibit-P7, Crime Detail Form, which has got drawing of the recovery-spot, discloses that place no.2 shown by alphabets 'E F D G', was the place of alleged recovery and adjacent to it in the southern side, a closed shop of Sushil Kumar shown by numerical 7' is situated, which suggests that the closed shop of Sushil Kumar has got a separate entity and was having separate boundaries, which is stated to be the licensed premises of the petitioners. 9. Recital of FIR impugned does also indicate that no allegations are there against both the petitioners. 10. During pendency, one of the petitioner Moti Ram son of Birda Ram has died, so far as surviving petitioner Raj Kumar is concerned, he has been a valid licensee, authorised to vend lanced poppy heads for the period under dispute. 11. Location of licensed premises is also similar, which has been shown in Exhibit-P7, since in south of it, a tea-shop has been shown, which is similar to Exhibit-P7. 12. Record also reveals that apart from actual spot of alleged recovery of the contraband, licensed shop of Sushil Kumar, which was locked and was adjacent to the shop raided, was searched after breaking open its locks, which was neither legally intended nor required, since licensed shop of petitioner/s a third person having valid vending authority to vend Poppy was not required to be searched, rather it was a misdemeanour on the part of Investigating Agency. 13. Main and actual accused Sushil Kumar son of Rajendra Prasad, whose premises was raided and allegations were there against him regarding unlawful possession of contraband, has already been acquitted by learned competent court of Special Judge, NDPS Act Cases, Jhunjhunu on 13.09.2012 vide Session Case No.26/2010 and learned trial court has observed that several mandatory provisions were not adhered by the prosecution, which ultimately resulted acquittal of accused Sushil son of Rajendra Prasad. 14. Nothing objectionable is stated to have been recovered from the licensed premises of the petitioner/s, which was searched unauthorisedly after breaking open locks since it was a licensed premises of another individual and was nothing to have with the alleged contravention, besides, trial of Sushil Kumar has already been concluded with a finding of acquittal and proceedings against deceased Moti Ram have been abated because of his demise. 15. 15. In such situation, if the matter is permitted to be proceeded against the petitioner/s, it will amount to gross abuse of process and its outcome would be negative and the same will also be a futile exercise. 16. In Shiji @ Pappu & Ors. v. Radhika & Anr., AIR 2012 SC 499 , apex court has observed in para 13 as under :- "It is manifest that simply because an offence is not compoundable under Section 320 IPC is by itself no reason for the High Court to refuse exercise of its power under section 482 Code of Criminal Procedure, 1973. That power can in our opinion be exercised in cases where there is no chance of recording a conviction against the accused and the entire exercise of a trial is destined to be an exercise in futility. There is a subtle distinction between compounding of offences by the parties before the trial Court or in appeal on one hand and the exercise of power by the High Court to quash the prosecution under section 482 Code of Criminal Procedure, 1973. on the other. While a Court trying an accused or hearing an appeal against conviction, may not be competent to permit compounding of an offence based on a settlement arrived at between the parties in cases where the offences are not compoundable under Section 320, the High Court may quash the prosecution even in cases where the offences with which the accused stand charged are non-compoundable. The inherent powers of the High Court under section 482 Code of Criminal Procedure, 1973. are not for that purpose controlled by section 320 Code of Criminal Procedure, 1973. Having said so, we must hasten to add that the plenitude of the power under section 482 Code of Criminal Procedure, 1973. by itself, makes it obligatory for the High Court to exercise the same with utmost care and caution. The width and the nature of the power itself demands that its exercise is sparing and only in cases where the High Court is, for reasons to be recorded, of the clear view that continuance of the prosecution would be nothing but an abuse of the process of law. It is neither necessary nor proper for us to enumerate the situations in which the exercise of power under Section 482 may be justified. It is neither necessary nor proper for us to enumerate the situations in which the exercise of power under Section 482 may be justified. All that we need to say is that the exercise of power must be for securing the ends of justice and only in cases where refusal to exercise that power may result in the abuse of the process of law. The High court may be justified in declining interference if it is called upon to appreciate evidence for it cannot assume the role of an appellate court while dealing with a petition under section 482 of the Code of Criminal Procedure, 1973. Subject to the above, the High Court will have to consider the facts and circumstances of each case to determine whether it is a fit case in which the inherent powers may be invoked." 17. Adverting upon entire afore-discussed material, this court finds that it would not be permissible at all to permit continuance of the trial of the accused petitioner/s since not only it will be an abuse of process but also prosecute innocent person/s. In such circumstances, justifiably, it is found to invoke inherent powers available under section 482 of CrPC, 1973 to prevent abuse of process and to meet ends of justice and to check futile exercise from moving ahead, to quash criminal proceedings against the petitioner. 18. Thus, the petition is allowed and charge-sheet dated 03.02.2010 arising out of FIR No.76/2009 dated 16.07.2009, Police Station Mukandgarh, District Jhunjhunu against the present petitioner Raj Kumar and all the proceedings undertaken in furtherance thereto are quashed and petitioner Raj Kumar is discharged from the charge/s levelled. The instant petition stands disposed of in aforesaid terms. Appended Stay Application No.1208/2010 also stands disposed of accordingly.
