JUDGMENT S.N.Pathak, J. – Heard the parties. 2. Petitioner has approached this Court with a prayer for a direction upon the respondents to appoint him on the post of Constable, as he has been declared successful in all the events in the recruitment process of Jharkhand Police Competitive Examination, 2015. Further prayer has also been made for a direction upon the respondents to issue appointment letter to the petitioner along with all service benefits, which have been given to the other similarly situated persons. 3. On the direction of the Court passed in W.P.S. No. 3239 of 2017 (Mithun Kumar and Ors. Vs. State of Jharkhand & Ors.), an Apex Medical Board was constituted and the petitioner along with others were also called for remedical examination, wherein it was found that the petitioner was medically unfit. 4. Today, when the case was called-out, Mr. Sanjoy Piprawall, learned counsel appearing for the respondent-JSSC very fairly submits that in compliance of the order of this Hon''ble Court in W.P.S. No. 3239 of 2017, the petitioner along with others were medically re-examined and upon his re-medical examination, it has been found that petitioner is medically unfit to be appointed on the post of Police Constable. A report of the Apex Medical Board has been brought on record by Mr. Sanjoy Piprawall and the same is taken on board. 5. As the petitioner has been declared unfit by the Apex Medical Board, no case is made out for interference. 6. Resultantly, the writ petition is hereby dismissed.
