JUDGMENT Mahesh Grover, J. (Oral) - The instant writ petition has been filed under Article 226 of the Constitution of India seeking issuance of a writ in the nature of Mandamus directing the official respondents to initiate action against respondent no.4 who has completely destroyed the agricultural fields of the petitioner and other family members by indulging in extensive mining. 2. It has been alleged that on account of the illegal mining activities and storage of heaps of extracted mined minerals on the fields of the petitioner, extensive damage has been caused to the land which is agricultural in nature. 3. We have sought the response of the official respondents as also respondent no.4 who have come on record to state that the petitioner has executed agreement with respondent no.4 permitting him to use the agricultural land for the purposes of dumping of extracted mineral. 4. This Court then granted the petitioner time to respond to the stand of the official respondents as also respondent no.4. Despite several opportunities the affidavit in this regard has not been filed by the petitioner. So much so that this fact of having entered into agreement with respondent no.4 has been conveniently withheld from the Court. It is thus a clear misadventure on the part of the petitioner who has not only wasted the time of the Court but has also misled it. Hence, instant petition is hereby dismissed with costs of Rs. 50,000/- which shall be deposited in the account of Punjab and Haryana High Court Employees Welfare Association within a period of one month from the date of receipt of the certified copy of this order. 5. As the main case is dismissed, all the pending applications are also dismissed.
