JUDGMENT Mohammad Rafiq, J. - This is an unusual kind of habeas corpus petition where the daughter is alleging that her father has subjected her to frequent beating. Petition has been filed by Shrawan Lal Meena along with copy of letter which the corpus Ms. Vinita sent to an Hon'ble Judge of this Court alleging that she was being beaten in her house. Her father subjected her to beating on 25th and 26th October. Harassed by her father, she went to Jodhpur where her friend Pooja took her to an N.G.O. where she met with one Ms. Suman Porwal. She further alleged in the letter that Ms. Suman Porwal took her to office of Women Commission, which sent a notice to her parents. When her parents were called, they assured that she would not be subjected to beating again in future. Theerafter, she was persuaded to go back to her parents and was asked to come back after 12 days. When they again appeared before the lady office bearer of the Women Commission, she tried to sort out differences between them and persuaded Vinita to come back after one month. Vinita further wrote in the letter that that lady office bearer told her to be in touch with her. When she returned back home, her father snatched her mobile phone. Her father subjected her to beating for 2-3 days, as a result of which she had high temperature. Her father snatched all her documents and books. When she insisted on applying for employment, her father reprimanded her and rather abused her. She was locked in a room and was not allowed to go out. She was forbidden to wear jeans and 'payjama' etc. and was asked to wear traditional clothes. Sometimes thereafter, her father subjected her to beating by pipe and the beating was so severe that she could even stand on her legs. Thereafter, she was sent to her elder sister's house where she stayed for about 25-30 days, but there also a continuous vigil was kept on her. When she returned back home, she was again locked in a room and was not allowed to meet anyone. Vinita further alleged in the letter that her parents were forcing her to perform pooja for black magic and wear amulet (tabiz). She was being beaten again. It had become so frequent that she was being beaten almost every second day.

Considering that the petition was filed by a third person, we were initially not inclined to entertain the petition, but since the petition was accompanied by copy of letter, which Vinita had written to an Hon'ble Judge of this Court, we directed that Vinita be produced before this Court. S.H.O., Police Station Beawar City has produced Vinita before the Court today. Her statement has been recorded by Deputy Registrar (Judicial) of this Court, in which she has repeated allegations, which she made in her aforesaid letter. She has stated that she was preparing for competitive examination. She earlier once appeared in the competitive examination for appointment on the post of Junior Engineer, B.S.N.L. but missed the place in the merit list by few marks. When she wanted to again apply for private job or a government job, her father forbade her from doing so. Her parents want to forcibly marry her against her wishes. She does not want to go with her parents. 3. Vinita is major being 24 years old. We talked to her in the first session of the Court sitting. We then asked Vinita and her parents to sit together during break. They have talked to each other. Thereafter, when the Court again assembled in the second session, we again talked to Vinita and her parents. In these proceedings, Vinita broke down several times and wept uncontrollably. She insisted on not going with her parents. Her father is a retired army personnel. We find that Vinita is quite frightened at the idea of going back to her parents. 4. At this stage, Mr. B.N. Sandu, learned Additional Advocate General submitted that Vinita may be sent to Nari Niketan, Jaipur. She can prepare for competitive examinations and apply for employment while being there. 5. Vinita, present in the Court, has agreed to go to Nari Niketan, Jaipur.

For the present, therefore, we direct Superintendent, Nari Niketan, Jaipur to accommodate Vinita in Nari Niketan till such time, she gets appropriate employment and finds alternative accommodation. It would be open to the parents of Vinita to meet her and persuade her to come back to them. In case, Vinita at any point of time in future agrees to go back to her parents, we expect from her parents, especially her father, not to subject her to beating. 6. S.H.O., Police Station Beawar City present in the Court is directed to take Vinita to Nari Niketan, Jaipur. He is also directed to collect belongings of Vinita including her testimonials and educational certificates/degrees from her father and hand them over to Vinita in Nari Niketan, Jaipur within three days. The petitioner may also help Vinita in fining out a government/private job and in that connection, he may meet her during visiting hours with the permission of Superintendent, Nari Niketan, Jaipur. 7. With the aforesaid directions/observations, the present habeas corpus petition stands disposed of.
