JUDGMENT Daya Chaudhary, J. (Oral) - CM No. 3430-CWP of 2018 This application is for placing on record Annexure P-3. 2. Application is allowed and Annexure P-3 annexed with the application is taken on record. CWP No. 4082 of 2018 3. The petitioner is aggrieved by the action of the respondents in not taking any action on the application dated 31.05.2017 (Annexure P-1) submitted by the petitioner. The petitioner is stated to be getting irrigation from outlet No. 8720-R Barkandi Minor. He filed an application under Section 68 of the Northern India Canal & Drainage Act, 1873 before respondent No. 2 i.e. Deputy Collector, Abohar who is the competent authority to fix the turn of the water. On said application moved by the petitioner the report of the concerned Ziledar was called and statements of the parties were recorded. 4. Learned counsel submits that after recording the statements of the parties, the spot inspection was made and the demand of the petitioner was found to be genuine. The case was recommended for fixing the turn of water of the petitioner as well as co-applicant. Report dated 29.08.2017 was submitted before the Deputy Commissioner, Abohar. Learned counsel also submits that still the turn of water has not been fixed. The petitioner would be satisfied in case the directions are issued by this Court to take action on the application of the petitioner dated 31.05.2017. 5. Keeping in view the limited prayer of the petitioner and without stating anything on the merits of the case, the present petition is disposed of with a direction to respondent No. 2 to consider the application of the petitioner dated 31.05.2017 (Annexure P-1) and take necessary action in accordance with law within a period of four weeks from the date of receipt of certified copy of the order. In case the presence of the petitioner or any other person, who may be concerned, is required, they be intimated accordingly.
