JUDGMENT S. N. Pathak, J. – The present writ petition has been filed for a direction upon the respondents to appoint the petitioner on the post of LDC (Lower Division Clerk) in view of Advertisement floated by Jharkhand Staff Selection Commission (JSSC). On 12.06.2017, when the matter was taken up before this Court, a direction was given to the respondent-State for filing counter-affidavit and further it was observed that one post of Lower Division Clerk in the Secretariat of Jharkhand should be kept reserved till final disposal of this writ petition. 2. Today, when the matter was taken up, learned counsel for petitioner submits that suffice it would be if the writ petition is disposed of at this stage itself with a direction upon the petitioner to file a fresh representation in view of averments made in para 14 to the counter-affidavit and also Annexure-H, dated 29.06.2017 in which it has been specifically mentioned that in view of interim order passed by this Hon''ble Court, one post has been kept reserved and returned to the Department, the same shall be considered in accordance with law, within a stipulated time. 3. Learned counsel appearing on behalf of the respondent-JSSC very fairly submits that the JSSC has already returned one post to the State and the State is free to take its own decision, in accordance with law. 4. Learned counsels for the respondent-State does not object the submission of the learned counsel for the petitioner. 5. In view of the submissions made by the learned counsel for the parties, without going into the merits of this case, I hereby direct the petitioner to prefer a fresh representation before the respondents, annexing all the relevant documents along with a copy of this order, within a period of three weeks from the date of receipt of a copy of this order. On receipt of such representation, the respondents are directed to take its own decision and consider the case of the petitioner and pass a reasoned order, in accordance with law within a period of six weeks thereafter. 6. Needless to say that if the petitioner is found entitled for the aforesaid benefits, the same shall be given to him within a further period of three weeks. 7. With the aforesaid directions, this writ petition stands disposed of.
