JUDGMENT Mrs. Anita Chaudhry, J.:- CRM-8695-2018 1. Application is allowed as prayed for and Annexures P-3 and P- 4 is taken on record. CRM-M No.-7897 of 2018 2. The petitioner is seeking regular bail in FIR No.144 dated 12.09.2017 registered at Police Station Sector 19, Chandigarh under Section 306 IPC. 3. Learned counsel for the petitioner contends that the petitioner is in custody since 12.09.2017 and the allegations are false and the wife was suffering from depression and anxiety and she was getting medical treatment and the couple had been married for 9 years and they were living in a rented accommodation and the landlord has also made a statement. Counsel further submits that the petitioner has never travelled abroad and the passport had been deposited with the police. 4. On the last date of hearing, the case had been adjourned to enable the complainant to make the statement in Court. The counsel has placed on record his statement which shows that further examination-inchief was got deferred as the State wanted to move an application under Section 319 Cr.P.C. 5. The charge has been framed under Section 306 IPC. A suicide note was left where the deceased had blamed the husband for having an affair with an Australian girl. Towards the end she had revealed her feelings for him. 6. The trial would take longer as an application under Section 319 Cr.P.C. has been filed, bail is allowed to the petitioner. He is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate on a condition that he would not go abroad. He will take prior permission of the Court in case he has to travel. He would also deposit Rs.50,000/- in the shape of FDR in the name of the minor child with the trial Court.
